I’m going to attach a link to the judgement in this medical negligence case. I recommend that UK clinicians read it. I think it is a good exposition of the level of inquisition into decision-making, and the placement of the decisions in the time-frame in which they were made.

In summary, a reasonable alternative treatment:

  • Must have been used in same clinical context and be in knowledge of a competent clinician
  • Not just a variant
  • Must be an accepted practice
  • Must be appropriate not just a possible option
